1. General

1.1 These General Terms and Conditions apply to all agreements and interactions between Zoéf_ and its customers, and govern all purchases made through www.zoef-label.com.

1.2 Zoéf_ is a fashion label operated by Nina Gertsen Styling, registered in the Netherlands under KVK number 78226597.

2. Application

2.1 These conditions apply to every offer, transaction, and delivery of items from Zoéf_ to customers acting as private individuals (consumers).

3. Product Information, Pricing & Errors

3.1 Zoéf_ is not obligated to honor or fulfill an order if:

- (a) there was an error in the pricing, item description, or characteristics;

- (b) it should have been clear to the customer that this was a mistake (e.g., a clear typo);

- (c) or the customer could not reasonably expect the item to be offered under those conditions.

4. Prices

4.1 All prices on the website are displayed in euros (€) by default and include VAT. Depending on your location, the currency may automatically adjust to your local currency.
4.2 Prices exclude shipping costs, which are calculated at checkout.

5. Market

5.1 Zoéf_ currently ships to customers within the EU, UK, Norway, and Switzerland.
5.2 We only sell to consumers (natural persons not acting in the course of a profession or business). Therefore, VAT is not reclaimable.

6. Shipping Costs

6.1 Shipping costs are not included in the product prices.
6.2 Final shipping rates are shown during checkout and may vary by location and time.
6.3 Zoéf_ is not responsible for customs duties or import taxes that may apply outside the EU.

7. Availability

7.1 All items are subject to limited availability. Zoéf_ works with small, curated collections and exclusive fabrics. Availability is not guaranteed until payment is completed.

8. Payment

8.1 Accepted payment methods include:

- iDEAL/ WERO

- Credit card (Visa, Mastercard, American Express)

-Bancontact

8.2 Payments are processed securely via Shopify Payments or PayPal.

9. Agreement of Sale

9.1 Adding a product to your cart or wishlist does not constitute a sale.
9.2 A purchase agreement is only concluded once Zoéf_ has received confirmation of payment.
9.3 Zoéf_ reserves the right to refuse or cancel orders at any time, without giving a reason. In that case, any payments already made will be refunded.

10. Returns & Refunds

10.1 For return conditions, please refer to the Returns Policy section on our website.
10.2 You have the legal right to withdraw from your purchase within 14 days after receiving your order, including discounted/sale items, provided the item is returned in original, unworn condition.

11. Applicable Law

11.1 All agreements and use of this website are governed by Dutch law.
11.2 Any disputes shall be settled by the competent court in Amsterdam, unless otherwise required by mandatory law.

12. Privacy & Personal Data

12.1 Zoéf_ handles your personal data with care and in accordance with the General Data Protection Regulation (GDPR).
12.2 Data you provide is securely stored and used only for processing your order and after-sales service.

13. Force Majeure

13.1 Zoéf_ is not liable for any failure to perform or delay in performance due to circumstances beyond its reasonable control. These include but are not limited to natural disasters, strikes, pandemics, cyberattacks, transport disruptions, or government-imposed restrictions.

14. Customer Accounts

14.1 If you create an account on our website, you are responsible for keeping your login credentials secure.
14.2 Zoéf_ reserves the right to suspend or delete accounts in the case of misuse, fraud, or inactivity.

15. Complaints Procedure

15.1 If you have a complaint about our products or services, you can contact us via email at info@zoef-label.com.
15.2 We aim to respond within 14 working days. If the issue cannot be resolved mutually, it may be submitted to the competent court or to the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr

16. External Links & Third Parties

16.1 Our website may contain links to external platforms such as Instagram, Spotify, or third-party tools.
16.2 Zoéf_ is not responsible for how these platforms process your data or the content they display. Please refer to their terms and privacy policies.

17. Email Communication

17.1 By subscribing to our newsletter, you agree to receive occasional promotional emails.
17.2 You can unsubscribe at any time using the link in each email.
17.3 Transactional emails (e.g., order confirmation, shipping updates) will still be sent even if you opt out of marketing.

18. Intellectual Property & Usage Restrictions

18.1 All content on this website  including product designs, photography, logos, text, videos, styling, and layouts. Is the exclusive property of Zoéf_ or its licensors and is protected under Dutch and international copyright and trademark laws.

18.2 It is strictly prohibited to:

- Copy, reproduce, or distribute any content or product designs;

- Use Zoéf_ brand materials, images, or logos for commercial purposes without prior written consent;

- Create confusion by imitating the look & feel or visual identity of Zoéf_;

- Use any content from this website for editorial, promotional, or resale purposes without approval.

18.3 Unauthorized use may result in legal action.
